SAN JOSE, Calif.—Prosecutors and defense lawyers are scheduled to deliver opening statements Wednesday in the highly anticipated criminal trial of Theranos Inc. founder Elizabeth Holmes, who faces federal charges of defrauding patients and investors with claims of revolutionary blood-testing technology.

The opening remarks in court will be the first opportunity for the former chief executive’s lawyers and the prosecutors with the U.S. attorney’s office in the Northern District of California to influence the jury in a trial expected to last more than three months. Ms. Holmes rose to fame as a Stanford University dropout who founded what appeared to be a cutting-edge health company, which was valued at more than $9 billion before imploding over questions about its technology.

Prosecutors will lay out their case against Ms. Holmes, whom they have accused of fraudulently touting Theranos’s blood-testing machines as being able to test accurately and reliably for a range of health conditions using a few drops of blood from a finger prick.

검사들은 손가락으로 부터 얻은 몇 방울의 혈액으로 전반적인 건강 상태를 알아 낼 수 있다는  혈액검사기계를 허위로 선전한 것에 대해 고소할 것이다. 

 

As The Wall Street Journal reported in 2015, Theranos only used its finger-stick machines to analyze a small percentage of its blood tests and instead routinely used commercial analyzers and blood drawn from an arm vein.

To win a conviction, government lawyers must convince the jury that Ms. Holmes intended to commit fraud, not simply that the company ran into problems living up to its promises.

Weeks of witness testimony are expected to follow opening statements. Prosecutors have identified more than 180 potential witnesses. Ms. Holmes is among 55 potential witnesses that her lawyers said they may call if she chooses to present evidence in her own defense. Both sides have flagged thousands of exhibits they could enter as evidence, including emails, text messages, media articles and internal Theranos documents.

Theranos dissolved in 2018, months after Ms. Holmes and another former executive, Ramesh “Sunny” Balwani, were indicted in the criminal case. By that point, the company also faced a wave of civil lawsuits from investors and patients, had reached a settlement along with Ms. Holmes with the Securities and Exchange Commission, and was dogged by other regulatory issues.

사기의 영역은 보편적이고 우주적이다. 어느 영역도 그가 도달하지 못하는 곳은 없다. 마치 진리의 빛이 도달하 지 못할 것이 없는 것처럼. 키신저나 제임스 메티스 같은 정계의 혹은 경제계의 거물들이 이사회에 앉아 있던 기업이다. 각 언론들은 혁명적인 신생기업의 탄생에 감탄하고 인류 의학 기술의 또 다른 혁명적인 진보에 대해 연일 극찬을 쏟아 냈다. 스탠포드를 19세에 그만두고 테라노스를 세운 엘리자베스는 인류 기술의 진보를 신앙으로 믿고 있는 그들의 여신이자 뮤즈가 되기에 충분한 스토리를 가지고 있었다. 하지만 사기의 전말이 대부분 그렇듯 얼마가 지나지 않아 의심을 사게 되고, 의심은 해소되지 않고 의혹이 되고 격국은 의혹이 눈덩이처럼 커져 폭발해 버림으로써 사기사건의 전말이 세상에 알려지게 되었다. 없던 기술을 있다고 하였고, 유명인들을 간판으로 내세우며 대중에게 신뢰를 얻었고 환자들과 투자자를 속에 취하게 된 거대한 이익은 세계인에게 미국의 경제 및 정계의 씁쓸하고 수치러운 민낯을 또 한 번 드러내 보였던 것이다. 어쩌면 엘리자베스 홈스를 두고 대단한 사람으로 여기는 분위기가 조금은 있는 지도 모르겠다. 현대 사회의 헛점을 잘 이용해 잠시지만 그 어린 나이에 거대 언론들이 칭송하는 위대한 인물의 반열에 올랐었기 때문이다. 그래서 이 재판을 끝까지 관심을 가지고 보아야 할 지도 모르겠다. 그 타고난 놀라운 사기의 기술이 재판이 진행되면서 어떻게 앞으로 펼쳐질 지 모르기 때문이다. 손에 땀을 쥐게하는 경기가 될 지도 모른다. 검사들에 의해 주장되는 수십년에 달하는 그녀의 징역행이 결국은 바람 빠지는 풍선처럼 확 줄어들지 누가 알일인가? 사기는 늘 진행형이지 않을까?
